Terms and conditions

 

 
 
  1. Information on how to enter and the prize details form part of these Terms and Conditions. Participation in the HESTA Super Checkpoint 2021 Competition ("Competition") is deemed acceptance of these Terms and Conditions.

  2. Promoter


  3. The promoter of the Competition is H.E.S.T. Australia Ltd ABN 66 006 818 695 AFSL No. 235249 ("Promoter"), as Trustee of Health Employees Superannuation Trust Australia (“HESTA”) ABN 64 971 749 321, of Level 20, 2 Lonsdale Street, Melbourne, VIC, 3000.

  4. Competition Period


  5. The period of this Competition begins at 9:00am (AEST) on 13 April 2021 and ends at 11:00pm (AEST) on 15 May 2021 (“Competition Period”). No entries will be accepted outside the Competition Period.

  6. Eligibility to Enter


  7. Entry is only open to Australian residents aged 18 years and over who are members of HESTA in one or more of the following products:
    (a) HESTA super;
    (b) HESTA Personal Super;
    and remain a member of one or more of those HESTA products at the time of the prize draw. For the avoidance of doubt, entries of HESTA members who cease being a member on or prior to 11:00am (AEST) on 26 May 2021 will not be eligible.

  8. Employees (and their Immediate Family Members) of the Promoter, related body corporate of the Promoter, and any agency associated with this Competition are ineligible to enter. Immediate Family Members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

  9. How to Enter


  10. To enter the Competition, an eligible entrant must during the Competition Period, login to HESTA Member Online at my.hesta.com.au/login and view their Super Checkpoint dashboard (my.hesta.com.au/scp). If the eligible entrant does not have a HESTA Member Online account, they will need to complete the registration process before logging in and viewing their Super Checkpoint dashboard. Upon successfully viewing their Super Checkpoint dashboard, each eligible entrant will receive one (1) entry into the prize draw subject to clause 4. There is no cost to enter this Competition, but internet connection and usage charges may apply.

  11. Only one (1) entry is permitted per member account, regardless of the number of Super Checkpoint dashboard sessions logged.

  12. Prize Draws


  13. Entries open at 9:00am (AEST) on 13 April 2021 and close at 11:00pm (AEST) on 15 May 2021. The prize draw will be conducted by random selection by Trade Promotions and Lotteries Pty Ltd, Level 2, 11 York Street, Sydney NSW 2000 at 11 am (AEST) on 26 May 2021 (Electronic Drawing System Approval Number 1224 (SA)). The winner does not need to be present at the prize draw unless expressly stated to the contrary.

  14. The Promoter may draw additional reserve eligible entries (and record them in order). In the event of an invalid entry or an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize can’t be awarded to the entrant drawn, the Promoter will then continue this process until the prize is awarded.

  15. The winners of the prize draw will be notified by email and phone within two (2) business days of the draw, by no later than 31 May 2021. Each winner’s name will be published at www.hesta.com.au/competitions within 5 business days of the prize draw.

  16. Prizes


  17. The first five (5) valid entries drawn in the prize draw will each win an Apple iPhone 11 64GB, valued at $999 (“Apple iPhone”). Apple is not a participant in or sponsor of this Competition.

  18. The Apple iPhone will be posted to the winner by registered mail, at the Promoter’s cost.

  19. Unclaimed Prize Draw/s


  20. The Promoter will take all reasonable endeavours to make contact with the winner.

  21. Subject to clause 15, if any of the five (5) Apple iPhones have not been claimed within three months of the prize draw, the Promoter will conduct a further draw for any unclaimed prizes on 26 August 2021 at the same time and place as the original draw.

  22. Before the Promoter conducts a re-draw under clause 14, the Promoter will notify any regulatory authority and comply with any directions from any regulatory authority as required by law.

  23. Each winner of an unclaimed prize draw will be notified by email and phone within two (2) business days of the re-draw, no later than 31 August 2021. Each winner’s name will be published at www.hesta.com.au/competitions within 7 days of the re-draw.

  24. Subject to clauses 14, 15 and 16, if a winner has still not taken possession of their prize by the time stipulated by the Promoter, then the unclaimed prize will be forfeited.

  25. Personal information of entrants


  26. Entrants consent to the Promoter publishing their first name, first initial of their surname and state at hesta.com.au/competitions in the event they are a winner.

  27. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties for the purposes of the Competition, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

  28. General


  29. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment. Entries into the Competition will be deemed accepted at the time of receipt by the Promoter and not at the time of submission by the entrant.

  30. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  31. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  32. This is not a game of skill. The five (5) prize winners from the prize draw will be selected at random through an automatic selection process.

  33. The Promoter’s decision is final and no correspondence will be entered into.

  34. The total value of the prize pool is AU$4,995.

  35. The prizes are not transferable or exchangeable and cannot be taken in any other form (including not being able to be taken as cash).

  36. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  37. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.

  38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

  39. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of the prize. The Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the items specified in items (a) to (e) in this clause 34.

  40. As a condition of accepting the prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  41. This Competition is authorised under ACT Permit No. TP 21/00499.

  42. Any entrant (who the Promoter automatically enters into the Competition when they view their Super Checkpoint dashboard) who no longer wishes to participate in the Competition can email hesta@hesta.com.au and request for their entry to be removed from the prize draw.

  43. Facebook may be used to advertise or promote the Competition. By entering the Competition, entrants agree that the Competition is in no way sponsored, endorsed or administered by, or associated with Facebook and to release Facebook from all liability in relation to this Competition. Any questions, comments or complaints regarding the Competition should be directed to the Promoter and not Facebook.
